I have recently had the same experience. 2 months to Fix A/C in 117 Degree Palm Desert heat. Still not fixed but fully approved by them.

I have also had several situations with Fidelity Home Warranty. The most recent was when my water heater started to leak.

Payless Water Heaters was called to look at my 20 year old 40 gallon self cleaning water heater. Payless told Fidelity that Mobile homes are required to have Mobile home water heaters and mine is residential. I purchased the house in 2016 . I sent them a letter from HCD that sites the case law 18031.7 the law says residential heaters and water heaters are legal in mobile homes.

On top of that Fidelity cash out offer was 983.00 and payless gave me an outrageous estimate of 2,500 to put in a 30 gal mobile home water heater when my original was a 40 gallon self cleaning one. Fidelity said they would not listen to me only their contractors and would give a cash out but that they would not replace my water heater. A week later they said they would give me a free second opinion and a company called saying they would not come for another week and it was just to provide an opinion. I told them the water heater was already removed and sitting on my driveway.

I asked them what kind of opinion are they supposed to provide Fidelity? Fidelity already acknowledged it needs to be replaced and gave me a cash out price. They said that it's a process and could take another week before Fidelity approves. At that point I accepted the Fidelity cash out so i could find someone else to help with my water heater.

It took 10 days to receive the cash card from Fidelity.I was lucky I found a contractor from my neighborhood willing to give me there wholesale price and they installed it for me. I ended up paying 1,100 including the cost of the permits. I was tempted to start a class action myself especially against Payless .

Instead i reported them to the BBB and let GSMOL know so all mobile home members could find out the new case law and stop being taken advantage of..§ 18031.7 HEALTH AND SAFETY CODE64§ 18031.7. Replacement of water heaters with fuel gas burning water heaters; Warning label(a) Nothing in this part shall prohibit the replacement of water heaters in manufactured homes or mobilehomes with fuel-gas-burning water heaters not specifically listed for use in a manufactured home or mobilehome or from having hot water supplied from an approved source within the manufactured home or mobilehome, or in the garage, in accordance with this part or Part 2.1 (commencing with Section 18200).(b) Nothing in this part shall prohibit the replacement of appliances for comfort heating in manufactured homes, mobilehomes, or multifamily manufactured homes with fuel-gas appliances for comfort heating not specifically listed for use in a manufactured home or mobilehome within the manufactured home, mobilehome, or multifamily manufactured home in accordance with this part, Part 2.1 (commencing with Section 18200), or Part 2.3 (commencing with Section 18860).(c) Replacement fuel-gas-burning water heaters shall be listed for residential use and installed within the specifications of that listing to include tiedown or bracing to prevent overturning.(d) Replacement fuel-gas-burning water heaters installed in accordance with subdivision (c) shall bear a label permanently affixed in a visible location adjacent to the fuel gas inlet which reads, as applicable:cid:image001.jpg@01D33615.29D78680Matthew Weise MBACodes and Standards Administrator IHousing & Community Development

There are no service techs because there is no money in servicing home warranty companies. It’s impossible to get people to work for free, which is what home warranties are—free service, with lots of complaining and threatening.

There is a shortage of techs because the only was to exist as an HVAC warranty company is in high call volume, which means you as the homeowner get less of his time. He has to service ALL of Sacramento, at least everyone with a home warranty like yourself. If the company would pay out the going rate and let the HVAC companies charge normal prices or even a percentage off, contractors would be lining up to take some of the workload. Instead, they get one or two small starving companies and overtake them with the promise of tons of work and a thin margin.

Well the margin is thin all right, to the negative side in most cases, and whenever there is a profit, it has to come out of the homeowner’s wallet in the form of non-covered items. That’s why you have to wait and wait and wait. NO MONEY!!! It is YOU who doesn’t care about your tenant.

You are the one making money off renting out your property. If you weren’t greedy, you would pay to have the problem fixed right away, and let the tenant live there for rent free while you get it taken care of.

How does that feel? That’s basically the same thing you are saying about the home warranty company and the service providers.

Fidelity National Home Warranty in Dana Point, California - Denial to pay Claim for Obscenely Loud Screeching Motor

I have a pool cleaner motor that is screeching so loudly my neighbors are complaining. We cannot use the pool with the cleaner on. Being honest, I told the rep that is was still working just unusable because of the noise. Fidelity refuses to cover it because it doesn't cover noise. Wow, the motor could burn up and cause a fire, it's obviously not operating to specs. The motor has always been loud and the motor finally is ready to come apart - Fidelity's opinion is "too bad." I will pay for the new motor and to ship the old motor to the corporate offices of in CA. Attn: CEO. I will take a picture of the motor and advise all RE Agents and Brokers and Escrow Companies in South Orange County not to use Fidelity. Denying a simple obvious $400 claim, along negative reviews will hopefully make Fidelity become an ethical home warranty service. Larry
